The agreement

These terms are between you and Third Coast Films, LLC, 1606 Headway Cir, Austin, TX 78754, United States, which operates Proxell. Using Proxell means you accept them. If you are using it for a company, you are confirming you can accept them for that company.

What you get

A workspace that finds prospects from public signals, researches them, drafts email in your name, holds every draft for your approval, and sends approved email from a mailbox you connect or places it in your Gmail for you to send. Volume is capped by the product: a connected mailbox warms up over four weeks and never exceeds its daily cap.

You are the sender

Every email leaves from your mailbox, under your name, after you approved it. You are the sender and the initiator of that email under CAN-SPAM and any other law that applies to you. Proxell is the tool. In particular you agree to:

Use your own mailbox and domain, with a real name and a real physical mailing address in the footer.
Read every draft before you approve it, and approve only what you would send yourself.
Honour opt-outs. Proxell suppresses them automatically; you agree never to work around that.
Write only to businesses and to people at businesses, about business, in a market where that is lawful. Proxell is built for the United States. Sending to other jurisdictions is your call and your responsibility.
Not use Proxell for anything deceptive, unlawful, or for consumer marketing.

Your mailbox and your Google account

You grant Proxell only the permissions the Settings page describes, and you can revoke them at Google at any time. We use them only as the privacy policy says. If your mailbox provider blocks or limits sending, that is between you and the provider; Proxell will pause the mailbox and tell you.

Billing

Plans are billed monthly through Stripe at the price shown on the pricing page when you subscribed. You can cancel at any time and sending stops at the end of the paid month. Usage costs of third-party services you choose to connect, such as visitor identification, are yours. There are no refunds for partial months.

No promises about results

Proxell finds prospects and writes drafts. It does not promise replies, meetings, or revenue, and it does not promise that any email will reach an inbox. Deliverability depends on your domain, your mailbox provider, and what you approve.

Liability

Proxell is provided as is. To the extent the law allows, Third Coast Films, LLC is not liable for indirect or consequential loss, and its total liability to you for anything arising from Proxell is limited to the fees you paid in the three months before the claim.

Ending it

You can close your workspace by email at any time. We can suspend a workspace that breaks the sender rules above, and will say why. Suppression entries survive closure because they exist to stop mail.

Law and changes

These terms are governed by the laws of Texas. When they change, the date above changes with them and the change is noted in the dated log on the home page. Questions: wes@thirdcoastfilms.com.
